1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "Student", "Visitor") and Ubuntu Education English Academy ("the Academy", "we", "us", "our"), governing your access to and use of our website, digital portals, and educational services.

By visiting our website at ubuntueducation.academy, creating a portal account, submitting a registration form, or enrolling in any programme, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

If you are under 18 years of age, you confirm that a parent or legal guardian has consented to these Terms on your behalf.

2. Our Services

Ubuntu Education English Academy provides the following services:

• English language instruction across CEFR levels A1 to C2
• IELTS and TOEFL iBT examination preparation programmes
• Professional English courses for Business, Legal, and Medical contexts
• The Saturday English Hub — a community learning programme open to the public
• A digital student portal for accessing materials, assignments, and academic records
• A digital lecturer portal for class management and content delivery
• An administrative portal for institutional management

We reserve the right to modify, suspend, or discontinue any service at any time, with reasonable notice provided to enrolled students where possible.

3. User Accounts

3.1 Account creation

To access our digital portals, you must create an account with a valid email address and a secure password. You are responsible for maintaining the confidentiality of your login credentials.

3.2 Account security

You must not share your account credentials with any other person. You agree to notify us immediately at info@ubuntueducation.academy if you become aware of any unauthorised use of your account.

3.3 Accuracy of information

You agree to provide accurate, current, and complete information when creating an account or submitting any form. Providing false information may result in immediate account suspension without refund.

4. Enrolment and Fees

4.1 Enrolment process

Enrolment is subject to completion of our registration form, a placement assessment, and payment of the applicable programme fee. A place on a programme is only confirmed once payment is received and an official confirmation is issued.

4.2 Fees and payment

Programme fees are published on our website and subject to change. All fees must be paid prior to the commencement of classes unless a payment plan has been formally agreed in writing with academy administration.

4.3 Refund policy

• Cancellation before start date: Full refund minus a 10% administrative fee, provided notice is given at least 7 days before the programme start date
• Cancellation within the first week: 50% refund of programme fees
• Cancellation after Week 1: No refund is provided, except in exceptional circumstances at the sole discretion of the Academy
• Programme cancellation by the Academy: Full refund of fees paid for the cancelled programme

4.4 Attendance requirements

Students are expected to maintain a minimum attendance rate of 80% to remain enrolled and to sit end-of-level assessments. Students falling below this threshold may be required to repeat the level.

5. Code of Conduct

All users of our services — including students, lecturers, parents, and website visitors — are expected to behave respectfully and professionally. The following conduct is strictly prohibited:

• Harassment, bullying, discrimination, or abuse of any person based on race, gender, religion, nationality, disability, or any other characteristic
• Academic dishonesty, including plagiarism, cheating in assessments, or impersonating another student
• Unauthorised sharing or distribution of course materials, assessments, or portal content
• Uploading or distributing illegal, offensive, defamatory, or harmful content via our portals
• Attempting to gain unauthorised access to any part of our systems or another user's account
• Using our services for any illegal purpose

6. Intellectual Property

All content on our website and portals — including text, images, logos, course materials, videos, assessments, and software — is the intellectual property of Ubuntu Education English Academy or its licensors and is protected by applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use our materials for your personal educational purposes only. You may not:

• Copy, reproduce, or redistribute any course materials without written permission
• Sell, license, or commercially exploit any content from our website or portals
• Remove or alter any copyright or proprietary notices
• Use our logo, name, or branding without prior written consent

7. Portal Use

Our student, lecturer, and admin portals are provided to support academic activities. You agree to use these portals only for their intended educational and administrative purposes.

Lecturers uploading materials confirm that they have the right to share such materials and that doing so does not infringe any third-party intellectual property rights. The Academy is not liable for materials uploaded by individual staff members.

We reserve the right to monitor portal activity to ensure compliance with these Terms and to investigate any suspected misuse.

8. Disclaimers

Our website and digital services are provided "as is" without warranties of any kind. While we make every effort to ensure accuracy and availability, we do not guarantee that:

• Our website will be available at all times or free from errors
• Any information on the website is complete, accurate, or up to date
• The website is free from viruses or other harmful components
• Specific outcomes will be achieved through our programmes (e.g. particular IELTS band scores)

Links to third-party websites are provided for convenience only. We do not endorse or take responsibility for the content or practices of external sites.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the Academy and its staff shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of data, loss of income, or failure to achieve examination results.

Our total liability to you for any claim arising from these Terms shall not exceed the amount of fees you paid to the Academy in the three months preceding the relevant claim.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Termination

We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to the Academy, its students, or staff.

You may close your account at any time by contacting us in writing. Termination does not affect any outstanding financial obligations.

Upon termination, your right to access the portals and course materials will cease. Academic records will be retained in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Guinea. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Guinea.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Notify enrolled students and registered users by email at least 14 days before the changes take effect

Your continued use of our services after changes take effect constitutes acceptance of the updated Terms. If you do not accept the revised Terms, you must stop using our services and close your account.
